UK law typically provides two kinds of protection: non-molestation orders and occupation orders. Our solicitors can advise you about both. A non-molestation order prohibits a particular person from acts or threats of violence, intimidation, harassment, stalking or other forms of molestation.

In cases of actual or threatened violence, you can request that the non-molestation order contain a power of arrest, which exposes the person bound to the risk of arrest and prison in the event of violation. Note that a power of arrest cannot issue unless the parties share a residence.

An occupation order can be issued to remove a violent person from the applicant's home. This order can issue separately or together with a non-molestation order. While emergency relief in domestic violence cases can be ordered without prior notice to the abusive person, notice can be required in cases where the applicant is not under an actual immediate threat.
